Terms of Service

1. Acceptance of Terms

By accessing or using YetiWerks' websites, products, and services, including our MyHOA360 community management platform (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms.

2. Description of Service

YetiWerks provides community management, dues collection, compliance tracking, and communications services for residential lake communities and homeowners associations through its MyHOA360 platform. The Service may include watercraft registration, operator management, insurance tracking, launch access control, electronic dues collection, document management, and integrated billing functionality.

3. User Accounts and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must notify us immediately of any unauthorized use of your account.

Users must comply with all applicable federal, state, and local laws regarding watercraft operation, registration, and safety requirements.

4. Community Administration

Community administrators are responsible for configuring community-specific rules, compliance requirements, and access policies. Administrators may grant or revoke access based on compliance status, dues payment, or other community policies. Individual users are subject to the policies established by their community association.

5. Billing and Payment

The Service facilitates electronic dues collection and payment processing for community fees. By using payment features, you authorize the applicable transactions. Financial data is handled in accordance with the security and privacy requirements of our payment processors and is not shared with third parties for marketing purposes.

6. Data Collection and Use

We collect information necessary to provide the Service, including contact information, property details, and relevant community information. Please refer to our Privacy Policy for complete details on data collection, use, and your rights.

7. SMS / Text Message Communications

By providing your mobile phone number and opting in, you consent to receive SMS text messages from YetiWerks and your community association.

Consent is not a condition of purchase or use of the Service. You are not required to consent to SMS messages to use the Service or pay dues online.

Message frequency: Message frequency varies based on your community's activity and your account status. You may receive up to several messages per week during active seasons.

Message and data rates may apply depending on your mobile carrier plan.

Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message. After sending STOP, you will receive one final confirmation and no further messages will be sent unless you re-enroll. You may also manage SMS preferences in your account settings.

SMS messaging is facilitated through our SMS service provider. Message delivery is subject to carrier availability. We are not responsible for delayed or undelivered messages due to carrier issues. For information on how we handle your phone number, see our Privacy Policy.

8. Launch Access

Launch access privileges are contingent upon compliance with community requirements, which may include current dues payment and adherence to community rules. Launch access may be automatically suspended for non-compliance or manually revoked by community administrators for rule violations. Restoration requires resolution of the underlying compliance issue.

9. Intellectual Property

The Service, including its design, features, and content, is owned by YetiWerks, LLC and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without prior written consent.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We are not responsible for verifying the accuracy of user-submitted information or compliance with watercraft regulations.

11. Limitation of Liability

To the maximum extent permitted by law, YetiWerks, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless YetiWerks, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Nebraska.
